Comprehensive Terms and Conditions

These Terms and Conditions constitute a binding and final legal contract between Ghada Tourism Agency (First Party) and the beneficiary customer (Second Party). The customer acknowledges that their electronic approval or payment of any amounts constitutes an irrefutable acknowledgement of acceptance of these Terms.

Article One: Nature of the Contract and Legal Status of the Agency

The customer acknowledges that Ghada Tourism Agency acts as an "independent authorised intermediary" to arrange and book tourism services. The Agency's responsibility is limited to completing bookings, transferring data, receiving payments and delivering documents. The actual execution of services (flights, accommodation, transport) is under the exclusive responsibility of external service providers. Accordingly, the Agency disclaims legal liability for any failure, delay, cancellation, or poor service committed by the actual service provider.

Article Two: Air Ticket and Air Transport Booking Rules

Prices and Fees: Displayed prices include taxes at the time of booking and do not include airport fees or government taxes that may be levied in the future; the customer is obligated to pay these.

Booking Confirmation and Immediate Payment: Full ticket value must be paid immediately for issuance. Unpaid bookings are considered cancelled without notice.

No-Show: If the customer fails to travel or uses the ticket partially, the airline's strict policy applies and the right to claim a refund from the Agency lapses.

Flight Schedule Changes: The Agency provides no guarantees regarding schedule accuracy and disclaims responsibility for flight cancellations, delays, or boarding denials resulting from airline overbooking.

Travel Documents and Eligibility: It is the customer's sole responsibility to ensure passport validity, entry visas, and health requirements. The Agency bears no liability if the customer is denied travel or deported.

Infants, Children, and Pregnant Women Policy: If an infant turns two during the trip, a child ticket must be issued and the customer bears the price difference. Pregnant women are subject to airline policies and compliance is the customer's absolute responsibility.

Article Three: Travel Document Rules and Airport Procedures

The customer must be present and complete boarding procedures at least (3) hours before international departures and (2) hours before domestic departures. Any customer delay is considered a voluntary no-show, forfeiting all contractual rights.

Article Four: Hotel and Accommodation Booking Provisions

Hotel bookings are made based on supplier classifications. Official check-in time is 2:00 PM and check-out is 12:00 PM. The Agency fully disclaims responsibility for any malfunction or poor service within the hotel. All hotel bookings are non-refundable after confirmation unless explicitly stated otherwise in the booking document.

Article Five: Ground Transport, Meet & Greet Services

The customer must be at the specified location at the specified time. If the customer is more than (20 minutes) late, the transport company has the right to depart and the service is considered fully executed with no right to a refund.

Article Six: Tours, Programs, and Entertainment Activities

All tours and activities are optional. Customer absence for personal reasons does not entitle them to compensation. Any itinerary changes due to weather conditions or security considerations carry no financial liability for the Agency.

Article Seven: Visa and International Travel Services Policy

The Agency's responsibility is limited to reviewing documents and submitting the file to embassies. The customer acknowledges that visa approval or rejection is the absolute sovereign right of the embassy and the Agency gives no guarantee of issuance. All paid amounts and fees (embassy fees, facilitation company fees, Agency administrative fees) are non-refundable regardless of the application outcome.

Article Eight: Cancellation, Modification and Cash Refund Rules

Cancellations and modifications are subject to the specific terms of each airline, hotel, and supplier, plus the Agency's fixed service fees. If the actual supplier approves a refund, the Agency is not obligated to return funds until actually received from the service provider, within up to 30 business days, through the original payment method.

Article Nine: Payment Policy and Electronic Contract Validity (20-Minute Rule)

Full amounts due must be paid immediately through approved channels. The validity of this electronic contract, prices and booking availability is twenty (20) minutes from its creation. If the period expires without payment, the contract is automatically cancelled and the Agency has the right to revise prices according to current market rates with no right of objection by the customer.

Article Ten: Final Waiver of Judicial Claims

The customer acknowledges a final waiver of the right to bring any legal action against Ghada Tourism Agency for any damages arising from failures by airlines, hotels, visa offices, or transport companies, and agrees to direct any legal dispute exclusively to the actual service provider.

Article Eleven: Legal Validity of Proof and Judicial Jurisdiction

Electronic Evidence: Clicking the approve button or completing payment constitutes a valid electronic signature under Saudi evidence law.

Tax Invoicing (ZATCA): The official tax invoice is issued 15 days after the actual end date of the tourism programme to ensure financial account stability.

Exclusive Judicial Jurisdiction: This contract is governed by the laws of the Kingdom of Saudi Arabia. The courts of Medina have exclusive jurisdiction over any dispute arising between the parties.
